Terms and Conditions
These Terms and Conditions (together with our Privacy Policy) sets out the terms on which we supply tickets to you for The Hop Farm attraction and Events (the "Experience") at The Hop Farm, Kent (the "Location"). Please read these Terms and Conditions and the Privacy Policy carefully before booking tickets for the Experience whether you do so via our website at www.thehopfarm.co.uk (the "Website") or by speaking to our customer services department on the telephone ("Customer Services").
You should understand that by purchasing tickets to the Experience, you and your guests and other members of your group agree to be bound by and comply with these Terms and Conditions and you agree to the use of personal data in accordance with the terms of our Privacy Policy. If you refuse to accept these Terms and Conditions or the Privacy Policy, you will not be able to purchase tickets to the Experience. We advise that you print a copy of these Terms and Conditions for future reference.

1. YOUR EXPERIENCE
1.1 It is important to us that you and your fellow visitors enjoy visiting the Experience. We set out below some important rules which you and your fellow visitors will need to be aware of and comply with:
(a) We appreciate that not all families are the same but for the
purposes of the Experience and these Terms and Conditions, a
"Child" is someone aged between 3 years and 15 years old
(inclusive), an "Adult" is someone aged 15 years or over. We
reserve the right to request proof of age and this must be produced
on request. Please note that these ages relate to the age of the
Adult or Child at the time of visiting the Experience rather than
at the time you make your booking:
(b) Pets or other animals may not be brought in to the Experience
(except guide or hearing dogs);
(c) We will use reasonable endeavours to ensure the Experience is a
happy and memorable one for you and your fellow guests for all the
right reasons, however we cannot be liable for distress caused by
circumstances beyond our control (including but not limited to the
weather conditions).
2. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
When you give us your order (for example, by telephone or by completing the booking form) this constitutes an offer by you to us to buy a visit to the Experience. All orders by you are subject to acceptance by us, and we will confirm our acceptance of your booking by sending you an email ticket or a ticket sent in the post that confirms that your booking (or any other purchase) has been successful (the "Booking Confirmation Email"). The contract between us for purchase of tickets to the Experience (the "Contract") will only be formed when we send you the Booking Confirmation Email or posted ticket.
3. YOUR STATUS
3.1 You can only purchase tickets to the Experience if you are 18 years old or more.
3.2 Each Child must be accompanied at the Experience by at least one Adult and must remain under their supervision at all times while in the Experience.
3.3 Each booking must include at least one full paying Adult.
4. ADMISSION & RIGHT OF ENTRY
4.1 On arrival to the Experience you must bring (or, if you are not attending yourself, make sure that one of the Adults brings) the following with you to the Location on the day of your Experience:
(a) the booking reference number; and
(b) some proof of identity (such as a credit card
or driver's licence).
Our management reserve the right to refuse entry to you (and your fellow guests) if you fail to present either of the above when required on entry to the Experience.
4.2 In exceptional cases, our management reserves the right to refuse entry to individuals to the Experience, or remove those who have already been admitted, if in their reasonable opinion, the presence of those individuals is likely to considerably lower the enjoyment of other guests.
5. PHOTOGRAPHY & VIDEO RECORDING
5.1 Non-professional photography and video recording is permitted anywhere in the Experience. All images and videos must be for non-commercial use only.
5.2 We do not supervise the taking of non-professional photography and video recording at the Experience and so we cannot be responsible if you or any of your fellow guests (including any Child or Baby) is featured in any other visitor's photograph or recording which is subsequently published or distributed in any form.
5.3 You should be aware that we may carry out photography and video recording while you are in the Experience and we may wish to use certain images for promotional purposes.
6. PRICE AND PAYMENT
6.1 The price of entry to the Experience will be as quoted by us from time to time on www.thehopfarm.co.uk and will include VAT.
6.2 We reserve the right to change prices at any time, but changes will not affect orders in respect of which we have already sent you a Booking Confirmation Email, save in the case of an obvious error or mistake.
6.3 Payment for all tickets to the Experience must be by valid credit or debit card and are subject to such specific payment terms as we may notify to you when you make payment, including which cards we accept.
7. CANCELLATION/POSTPONEMENT OF THE EXPERIENCE
7.1 We reserve the right to postpone or cancel the Experience without notice for any reason. In the event of such postponement or cancellation, you will be entitled to equivalent priced ticket(s) for an alternative date or time(subject to availability). We will have no further liability whatsoever as a result of our postponing or cancelling your visit to the Experience including but not limited to any travel costs, loss of enjoyment, disappointment, emotional distress or any indirect or consequential loss (see also clause 9.2 below), whether incurred by you or another of your fellow guests.
7.2 We will use reasonable endeavours to update the Website to keep you informed about any potential postponement or cancellation of the Experience. Please review this regularly and in particular on the day of your departure to the Experience to avoid any wasted travel plans or costs.
7.3 Without prejudice to our other remedies, we shall have the right in the case of any serious or persistent breach of these Terms and Conditions to cancel and withdraw any ticket(s) issued to you. In the event of such cancellation, no refund will be paid and we reserve the right to exclude you from our future events.
8. TICKETS AND REFUNDS
8.1 Tickets are non-transferable and non-refundable.
9. OUR LIABILITY
9.1 Our liability for any losses you and/or any of your guests may suffer as a result of us breaching these Terms and Conditions or for any breach of any statutory duty or negligence or otherwise is strictly limited to the total purchase price of your tickets to the Experience.
9.2 To the maximum extent permitted by law, neither we nor any of our directors, employees or other representatives will be liable for any of the following losses or damage (howsoever arising and whether such losses were foreseeable or not):
(a) loss of data;
(b) loss of profit;
(c) loss of revenue;
(d) loss of business or opportunity;
(e) loss of goodwill;
(f) disappointment or emotional distress; and/or
(g) any indirect, consequential or special loss;
arising in connection with the Experience or the provision of our services to you.
9.3 Nothing in these Terms and Conditions shall exclude or in any way limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any liability which cannot be excluded or limited by law.
10. WRITTEN COMMUNICATIONS
10.1 When we need to communicate with you in writing we will use the email address that you provide us with. If you do not want us to communicate with you in writing by email, you must tell us.
10.2 All notices given by you to us must be given to The Hop Farm info@thehopfarm.co.uk We may give notice to you at either the email or postal address you provide to us when placing an order. Notices by email will be deemed to have been received at the time of transmission and, in the case of post, 48 hours from the date of posting.
11. EVENTS OUTSIDE OUR CONTROL
11.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by any event outside our reasonable control ("Force Majeure Event").
11.2 A Force Majeure Event (without limitation) the following:
(a) Strikes, lock-outs or other industrial action;
(b) Civil commotion, riot, invasion, terrorist attack or threat of
terrorist attack, war (whether declared or not) or threat or
preparation for war;
(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic
or other natural disaster;
(d) Impossibility of the use of public or private
telecommunications networks;
(e) The acts, decrees, legislation, regulations or restrictions of
any government; and/or
(f) High winds or any other extreme weather conditions which
necessitate the closure of the Location for the safety of our staff
and customers.
11.3 Our performance under these Terms and Conditions is deemed to be suspended for the period that the Force Majeure Event continues. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to provide a suitable alternative date on which you can enjoy the Experience.
12. GENERAL
12.1 If any of these Terms and Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
12.2 These Terms and Conditions and the Privacy Policy constitutes the entire agreement between us in relation to their subject matter and supersedes any prior agreement, understanding or arrangement between us, whether oral or in writing. We both agree that, save as expressly set out herein, neither party will have any liability for any untrue statement or representation made by it (whether innocently or negligently) upon which the other party relied in entering into these Terms and Conditions, unless such untrue statement or representation was made fraudulently. These Terms and Conditions and the Privacy Policy shall prevail over any inconsistent terms and conditions in any other agreement between us or referred to in correspondence or elsewhere and any conditions or stipulations to the contrary are hereby excluded and extinguished.
13. LAW AND JURISDICTION
13.1 These Terms and Conditions and the terms of our Privacy Policy shall be governed by and construed in accordance with the laws of England. You accept that any dispute under these Terms and Conditions and/or our Privacy Policy shall be subject to the exclusive jurisdiction of the English courts to which you submit.
14. INFORMATION ABOUT US
Our Website is operated by The Hop Farm. We are registered in England and Wales under company number 5317612 and our registered office is 23 St Leonards Road, Bexhill-on-Sea, East Sussex TN40 1HH. Our main trading address is The Hop Farm, Maidstone Road, Beltring, Paddock Wood, Kent TN12 6PY. Our VAT number is 851 3427 38.
15. COMPLAINTS
We accept that, despite every effort being made to ensure you have a trouble free, enjoyable family experience, things may occasionally go wrong. If you have a complaint you must inform our staff immediately. They will attempt to resolve the problem as soon as possible. If, however, an acceptable solution is not found and you wish to take the matter further, please email us (info@thehopfarm.co.uk) detailing in full the nature of the complaint, wherever reasonably practicable within 7 days of your visit. This will allow us to investigate your complaint fully.
16. CHALLENGE 25
Legally The Hop Farm cannot sell alcohol to anyone under the age
of 18 and colleagues face a personal fine on the spot if they are
caught doing so. This is why we have introduced a 'Challenge 25'
policy to help colleagues stay the right side of the law. If you
look under 25 you will be asked to prove you are over 18. However,
even people with ID are occasionally refused
TRADERS TERMS AND CONDITIONS
BOOKING & CONFIRMATION
On receipt of your deposit / payment we will acknowledge your
booking with an invoice. This will be your acknowledgement of your
booking and should be presented as you arrive on site to
unload.
Application for space comes on a first come first served basis for each category of goods sold. Persons reducing or cancelling a booking after space has been allocated will be liable for the full cost of their booking unless the space can be re-allocated, in which case fees paid, less 20%, will be refunded. All cancellations must be in writing.
Space will be allocated at the sole discretion of the Hop Farm, which shall have the power to refuse or disqualify any application or exhibit and need not state the reasons for the refusal or disqualification.
All stands/pitches must only promote one company that being the one named on the booking form. Promotion of second or third parties is strictly prohibited unless an application is made in writing to the event organiser prior to the event. Permission for promotion of third/fourth parties will then be granted at the Hop Farms discretion.
The sale of all refreshments will be strictly limited to those authorised by The Hop Farm.
DISCLAIMER OF LIABILITY - The Hop Farm shall not in any way
unless legally liable, be responsible for:
Any claim for compensation or otherwise in regard to the holding of
or for anything arising out of or in any connection with the
event.
Any accident that may occur or for the death, injury, disease or
loss arising.
Any claim for compensation or refund in the event of any show being
cancelled or disrupted due to bad weather, major incident, civil
unrest or any other cause beyond the organisers control.
Any loss or damage whatsoever arising from the abandonment,
cancellation of any show, and any such eventuality.
RESPONSIBILITY OF EXHIBITORS
The Hop Farm carries comprehensive Public Liability Insurance to
cover claims for which we are legally liable. We expect all
exhibitors to have the necessary Public Liability insurance for
shows and would strongly advise them to also insure themselves for
fire & theft, damage and cancellation. A copy of public
liability insurance must be submitted to the Hop Farm prior to the
event. Exhibitors are responsible for the safety (including fire
precautions) of their stands. The exhibitor shall assume full
responsibility for any article of any kind exhibited by them,
including liability for all claims arising out of the handling of
exhibits and the conduct of their stand generally. The
exhibitor shall indemnify The Hop Farm against all claims, damages
or expenses arising in any way out of the presence of the
exhibitor, his staff or his exhibits at the Event. Acceptance
of these provisions shall be condition of entry.
SETTING UP & SITE CLEARANCE
Access to the site for setting up purposes will vary for each
event, however full access times will be clearly set out in your
exhibitor packs. Access to the site outside the times set out
by the event organisers must be requested in advance of the event
and will be granted at the Hop Farms discretion.
Exhibitors must not break their stand down before the end of the event. In the interests of public safety no exhibitor/trader is permitted to move vehicles on site between the opening hours of that event.
All stands must be set up in an attractive manner. Boxes must be stored out of sight either behind the stand or returned to your vehicle. Nothing may be attached to marquee linings, where applicable. It is each stallholder¹s responsibility to keep stands clean and tidy and to clear the rubbish from their stand at the end of the show, placing all bags in the skips on site.
Any exhibitor or company in the event organisers opinion failing to comply with the regulations or any direction from the Hop Farm may be instructed to leave the site. Any site fees paid will not be refunded.
The event organisers cannot be held responsible for any loss or damage to stock or expenses incurred howsoever caused, including theft and all exhibitors/traders must take out their own suitable insurance cover. Security presence is provided at events, however stands erected/broken down overnight are at exhibitors own risk. Please note that the times that a security presence is on site will vary for each event.
EQUIPMENT & APPLIANCES
It is a condition of your booking that ALL the electrical equipment
you wish to connect to the show supply is inspected & tested to
the current Institute of Electrical Engineers (IEE) Wiring
Regulations. Each piece of equipment must have a sticker
denoting the date of test remember all equipment should
be tested at least once a year, so the sticker should not be older
than 12 months).
Gas appliances are only to be used following permission by The Hop Farm. All appliances must have current CORGI tested certificate.
Portable generators, motors or engines of any kind, amplifiers
and loud speakers are strictly forbidden, unless arranged with the
event organiser prior to the show.
Membership - TERMS & CONDITIONS
Please note: Members should visit our website for updates, latest
news and closures.
We hope you will enjoy all the many benefits of being a Member at
The Hop Farm Family Park. Terms and Conditions related to your
membership are listed below.
~ The Hop Farm Membership excludes all special event days.
~ The Hop Farm Membership will be valid on any operational day a
year from the time of purchase for the card holder only.
~ It is non-refundable and not transferable and can only be used by
the named person on the card.
~ Photo ID will be required with your membership card to gain entry
to the attraction.
~ One membership card will be issued. Replacement cards will cost
£5 per card to cover administrative costs.
~ Memberships purchased during special events will only be entitled
to a £5 refund on their entrance fee.
~ The Hop Farm Family Park attraction may close at any time due to
circumstances beyond our control and is continually improving its
facilities. We therefore reserve the right to close or withdraw
membership should the need arise. Closure days will not be added to
the membership duration.
~ Children under the age of 16 need to be supervised by an adult at
all times.
~ We reserve the right to refuse entrance to The Hop Farm at any
time.
~ Only one offer/ promotion can be used at any one time when
purchasing membership.
~ Members must present their membership card on arrival for
entrance to The Hop Farm Family Park.

Vouchers/ Offers - TERMS & CONDITIONS
Discounts/ Offers can only be used against full price
tickets.
Discounts/ Offers cannot be used against family tickets.
Discounts/ Offers will not be accepted on special event days or
bank holidays.
Only one voucher/ offer can be used per transaction.
We will not accept photocopies of discounts/ voucher offers.
